Japan Enacts Economic Security Bill, Mandating Background Checks for Private Sector Access

Japan's Lower House Passes Bill for Economic Security Information Protection

On April 9, 2023, Japan's Lower House passed a bill that will require individuals in the private sector to undergo government background checks for clearance to access economic security information. This move signifies a significant step towards strengthening Japan's economic security and aligning itself with other G7 nations that already have similar systems in place.

The bill garnered support from both the ruling coalition and major opposition parties, ensuring its passage during the current Diet session. This multi-party support reflects the growing recognition of the importance of protecting sensitive economic information in the face of evolving global challenges.

The new system will designate critical information in economic areas that could affect Japan's national security. Access to this information will be restricted to individuals who pass government background checks, which will delve into aspects such as criminal records, financial stability, and family ties. Leaking designated information will be punishable by imprisonment or hefty fines.

While the legislation has been met with some concerns regarding the potential for overly broad information designation and the exemption of Cabinet ministers from background checks, revisions were made to address these issues. The government will now be required to provide annual reports to the Diet on the designation of critical information and the implementation of the security clearance system.

The passage of this bill marks a crucial step for Japan in aligning its economic security measures with international standards and safeguarding vital information in an increasingly complex global landscape. It also signifies a shift in the political landscape, with the main opposition party demonstrating a willingness to collaborate on critical national security issues.
