US appeals court refuses to award VirnetX $502 million in patents

A US appeals court has ruled on Friday that Apple Inc. won't give a $502 million verdict for VirnetX Inc in a long-running fight over internet privacy technology.

The U.S. Court of Appeals for the Federal Circuit said the verdict could not be issued after the U.S. Patent Trial and Appeal Board canceled the virtual private network VPN patents VirnetX accused Apple of infringing.

The Federal Circuit's decision on Thursday followed a decision by the Federal Circuit to affirm a U.S. Patent and Trademark Office tribunal's finding that the patents were invalid.

Apple and VirnetX did not respond to requests for comment.

The two companies have been involved in a 13-year court battle over VirnetX's patents, which has included several trials and appeals. In 2020, an East Texas jury awarded VirnetX $502 million after finding that Apple infringed the patents at issue in the Federal Circuit cases.

In 2016, VirnetX won a $302 million verdict against Apple in East Texas, which was later increased to $440 million because of allegations that the tech giant used its internet-security technology in features like FaceTime video calls.
