Himachal Pradesh High Court Reserves Orders on Resignation of Independent Legislators

The Himachal Pradesh High Court is currently dealing with a case involving the resignation of three Independent Legislators of the HP Assembly. The arguments in this matter were completed recently, and the Chief Justice, MS Ramachandra Rao, has reserved the decision. Several individuals, including Senior Lawyer Kapil Sibal who joined virtually from Delhi, were involved in presenting arguments on behalf of the Assembly secretariat.

The case, which was heard in the bench of Justice MS Ramachandra Rao, focused on a petition to direct the Speaker to accept the resignations of the three independent MLAs. The argument, lasting about two hours, saw debates on whether the court or the Speaker should have jurisdiction in this matter. The legislators' advocates emphasized that the resignations were submitted voluntarily without any pressure and that no further inquiries were needed in this regard.

The Congress MLA from Shimla also filed an intervention application seeking the disqualification of the three Independent Legislators. The Court, however, declined to hear this application separately, choosing to reserve its decision. The MLAs in question had initially submitted their resignations to the speaker on March 22, 2024, and later took the matter to the High Court after the Speaker did not accept their resignations, leading to the current legal proceedings and reserved orders.
