Challenging Age Discrimination: The Fight to Remove the Age Cap from the National Disability Insurance Scheme

A decade after the implementation of the National Disability Insurance Scheme (NDIS), Peter Freckleton had high hopes that it would significantly improve his life. Having lived with a lifelong disability since contracting polio at the age of six, Freckleton's hopes were soon dashed when his request for NDIS coverage was denied due to the age cutoff. Determined to challenge this age discrimination, Freckleton has taken his fight to the United Nations, claiming that the age cap violates the Convention on the Rights of Persons with Disabilities. Despite exhausting all legal avenues within Australia, including lodging a complaint with the Australian Human Rights Commission, Freckleton's only remaining option is to seek resolution on an international level. With over 25,000 supporters signing a petition to remove the age cap, the campaign to address this issue is gaining momentum. The NDIS Minister acknowledges the unfairness of the current situation, but concerns about the financial implications of including older individuals in the scheme persist. Meanwhile, disabled individuals over the age of 65 continue to face limitations and insufficient support within the aged care system. The fight to remove the age cap from the NDIS aims to ensure equal access to essential services and support for all disabled individuals, regardless of their age.
