Lawyer seeks out-of-court settlement in designer suit burning case

A city lawyer, Gatheru Gathemia, has requested a two-week extension to settle a dispute with his tailor, Daniel Onyango Dinda, out of court. The case stems from a 2021 incident where Dinda allegedly burned Gathemia's Sh35,000 designer suit during alterations.

Gathemia initially sued Dinda, seeking compensation for the damaged suit. However, the case was dismissed by a resident magistrate in April 2022, who ruled that the agreement between Gathemia and Dinda to replace the suit was made under duress and was therefore illegal.

Gathemia has appealed the magistrate's decision, arguing that the damage was caused by Dinda's negligence and that the agreement was valid. Dinda, on the other hand, maintains that he was forced into signing the agreement and that the case was dismissed on merit.

The High Court judge, Janet Mulwa, has directed the parties to return to court on April 8 to report on the status of their settlement negotiations. If an agreement is not reached, the court will schedule a hearing date.
